Right of Withdrawal

 

 Right of rethinking and online withdrawal right according to European Directive 2011/83 / EU.
This directive provides the consumer with the right to withdraw from contracts or contract proposals, guaranteeing him the right to return the purchased product and to obtain reimbursement of the expenses incurred.
The right of withdrawal does not apply to audiovisual products and sealed computer software products, opened by the consumer or for customized or customized products.

The right of withdrawal can not be exercised if the product is not intact, namely:

in the absence of the original packaging
in the absence of integral elements of the product (accessories, instruction manuals, etc.)
in case of damage
The right of withdrawal is reserved exclusively for consumers (natural persons who purchase the goods not for purposes related to their professional, commercial or entrepreneurial activity), therefore can not be exercised by legal persons and by natural persons acting for purposes related to the activity professionally carried out.

The buyer may withdraw within 14 days from the date of receipt of the goods, in the place indicated in the sales proposal, without any penalty. Within this period, the purchaser may exercise said right by sending written notice to the registered office of the supplier - at the addresses indicated in the contact section - by registered letter with return receipt or by e-mail address pec bauhaus@legalmail.it
The communication may be sent, within the same period, also by telegram, provided it is confirmed by registered letter within the following 48 hours; and will be deemed sent in good time if delivered to the accepting Post Office within the latter term.

If the buyer has correctly exercised the right of withdrawal will still be required to return the goods purchased within 10 working days from the date of delivery of the same. To comply with this deadline, the date of delivery of the goods by the purchaser to the shipper will prevail.

The return to the supplier of the goods perfectly intact is an essential and necessary condition for the exercise of the right of withdrawal by the purchaser. The shipping costs of the goods to the supplier are entirely borne by the withdrawing buyer.
The supplier, after checking the compliance with the methods and terms for exercising the right of withdrawal and the integrity of the returned goods, will reimburse the sums already paid by the buyer, including those paid as a deposit.

The right of withdrawal can not be exercised by the buyer in the case of goods made to measure or clearly personalized in a manner different from the variants of sizes and / or colors expressly indicated in the catalog of products marketed by the supplier.
